TOWN OF GLENVILLE
ZONING BOARD OF APPEALS


        PLEASE TAKE NOTICE that the Zoning Board of Appeals will meet at the Glenville Municipal Center, 18 Glenridge Road, Glenville, NY 12302-4518 on Monday, August 27, 2012 at 7 p.m. to hear all persons interested in the following applications as provided for by the Zoning Ordinance of the Town of Glenville.


1)      Continuation of the Application of Uriah Corp for a Conditional Use Permit at 24 Worden Road to construct a Duplex Dwelling.  Tabled from the July 2012 meeting.


2)      Continuation of the Application of Uriah Corp for an Area Variance at 24 Worden Road to construct a Duplex Dwelling.  Tabled from the July 2012 meeting.


3)      Application of Steven & Lori Antal, 33 Rosemere Road, Ballston Lake, NY  12019 for 1 Area Variance to exceed the maximum allowable square footage of an accessory structure.  The applicants would like to construct a 28’ x 36’ (1,008 s/f) detached garage on the property.  Said property is located in the Suburban Residential Zoning District and is identified on tax map: 15.-1-2.15
        In accordance with the Codes of the Town of Glenville 270-9, G, (2): The maximum square footage for an accessory structure is 576 s/f.  Therefore the applicant is seeking a variance of 432 s/f.


4)      Application of Donald Brandt, 13 Schlensker Drive, Glenville, NY  12302 for 2 Area Variances.  The first variance request is to exceed the maximum allowable square footage of an accessory structure.  The second variance is to exceed the maximum average height of an accessory structure.  The applicant would like to construct a 26’ x 36’ (936 s/f) detached garage with a mean height of 16’.  Said property is located in the Suburban Residential Zoning District and is identified on tax map: 15.1-2-13.
        In accordance with the Codes of the Town of Glenville 270-9, G, (2): The maximum square footage for an accessory structure is 576 s/f.  Therefore the applicant is seeking a variance of 360 s/f. And, 270-9, D: The maximum height for an accessory structure shall not exceed 15’.  Therefore the applicant is seeking a height variance of 1’.


5)      Application of 654 Saratoga Road, LLC, c/o Todd Bush, 1520 Crescent Road, Clifton Park, NY  12065 for a Conditional Use Permit to establish a restaurant and bar (Pig ‘N Whistle at the Grove, LLC) with outside patio and outside group facilities at 654 Saratoga Road (former Millstone Speakeasy).  Said property is located in a Community Business Zoning District and is identified on tax map: 10.17-7-14.1.
        In accordance with the Codes of the Town of Glenville 270-18, C: Restaurant, cafes and other eating establishments, excluding fast food restaurants are permitted by Conditional Use Permit (and Site Plan Review).


6)      Application of RD Management LLC,  810 7th Avenue, 10th Floor, New York, NY  10019 to revise a previously approved variance regarding the reduction of landscape islands within the parking lot.  A variance was granted on 3/28/11 to reduce the required 19 island to 11.  The applicant is now seeking a revision to reduce it to 9.
        In accordance with the Codes of the Town of Glenville 270-151: …upon a rehearing, the ZBA may reverse, modify or annul its original decision, upon the unanimous vote of all members then present, provided a quorum is present…


7)      Continuation of the Application of RD Management for two Area Variances
at 8 Glenridge Road to encroach into the front yard setback and eliminate shade trees along the road.  Tabled from the July 2012 meeting.


8)      Application of RD Management, LLC, 810 7th Avenue, 10th Floor, New York, NY  10019, for a Conditional Use Permit to allow for the establishment of a new 3,800 s/f Panera Bread bakery-café with drive-thru at 8 Glenridge Road, Glenville, NY  12302.  Said property is located in  General Business and Town Center Overlay Zoning Districts and is identified on tax map: 22.11-4-15.121.
        In accordance with the Codes of the Town of Glenville 270-19, D, (1): Restaurants are permitted by Conditional Use Permit.


9)      Continuation of the Application of WS Plaza Inc for an Area Variance at 123 Saratoga Rd to allow for parking 2 feet to the side lot line.  Tabled from the July 2012 meeting.


10)     Continuation of the Application of Shady Lane Realty, Inc for two Area Variances
at 113 Saratoga Rd to allow for a new building to be 40’ high and 15 feet from the side lot line.
